Terms and Conditions

Please read this document carefully.
These conditions have been in effect for all Customers since March 1, 2021.
We strive to keep our general terms and conditions of contracting and use as clear as possible and provide you with all the necessary information about online transactions so that you can easily understand the entire process, from placing an order, delivery/pickup/information to a possible return if applicable.
It is very important to us that your online experience meets your expectations, so we ask you to take a few minutes and continue reading. Remember that you need to accept our general terms and conditions of contracting and use each time you make a transaction – they may change, so check the date at the top of the page.

1. Domain ztlm.eu
The site ztlm.eu is owned by ZTLM – SERVIÇOS E COMÉRCIO, LDA., headquartered at Beco do Dique, 59, Évora, registered at the RNPC Conservatory under the unique registration and corporate number 515190748, with a share capital of €3,000.00.

2. Object and scope of application
These general terms and conditions of contracting and use apply to visitors of the site and to any online commercial transactions with ZTLM – SERVIÇOS E COMÉRCIO, LDA.

3. Security conditions
ZTLM – SERVIÇOS E COMÉRCIO, LDA. prides itself on respecting the personal data of all users of its site and commits to protecting all personal information each user decides to provide.
There may be areas of the site that can be accessed without the provision of any personal information by the user. However, when it is necessary to collect data to provide products/services/information, or if the user decides to provide their personal data, the collection and use of these will comply with the applicable legislation on personal data protection – General Data Protection Regulation (GDPR) – ensuring the confidentiality and security of the personal data provided.
ZTLM – SERVIÇOS E COMÉRCIO, LDA. reserves the right to alter and update security procedures without prior notice, always respecting the rights of data subjects and guided by the principle of accountability as provided in the GDPR. Despite the aforementioned security procedures, there are risks associated with using the Internet that are beyond the control of ZTLM – SERVIÇOS E COMÉRCIO, LDA. and require the constant attention and care of data subjects.

4. Data processing
ZTLM – SERVIÇOS E COMÉRCIO, LDA. is the entity responsible for the collection and processing of personal data. The personal data provided by users will be subject to automated processing and will be included in the database(s) of ZTLM – SERVIÇOS E COMÉRCIO, LDA.
The personal data will be accessible to ZTLM – SERVIÇOS E COMÉRCIO, LDA. as the data controller and its subcontractors, only in that capacity and within the contracted limits. Subcontractors will only have access to the personal data strictly necessary to achieve the intended purposes.
The personal data provided to ZTLM – SERVIÇOS E COMÉRCIO, LDA. will be used exclusively for customer management, including profiling, and for marketing and advertising purposes. The data processing operations have the following legal bases:
– Execution of a contract: sale of products, services, deliveries, information; or
– Consent of the data subject: customer profile, profiling, and data transfer to third parties; or
– Legal obligation: invoicing.
If the data processing is based on the consent of the data subject, the data subject may withdraw their consent at any time, without affecting the lawfulness of the processing carried out until then.
The Data Subject may at any time request the Data Protection Officer to exercise the rights legally provided, namely:
– Right of access;
– Right to rectification;
– Right to erasure;
– Right to restriction of processing;
– Right to object to processing;
– Right to data portability;
– Right to lodge a complaint with the CNPD (National Data Protection Commission).

5. Products and Prices
All article and service prices are in euros and include VAT at the legal rate in effect, and are exclusive to online transactions.
ZTLM – SERVIÇOS E COMÉRCIO, LDA. reserves the right to substitute or modify available products, their prices, and presented conditions at any time, safeguarding already placed orders.
ZTLM – SERVIÇOS E COMÉRCIO, LDA. makes every effort to ensure the information presented is free of typographical errors (in descriptions, characteristics, values, and/or product images/photographs) and will correct them immediately upon detection.

6. Order placement
Users may place their orders online. Orders can be made 24 hours a day, 7 days a week.
After entering your personal data, you will be asked to confirm them and confirm your intention to place the order. Your order will not be accepted, and the contract will not be concluded until you receive an email confirmation of the order acceptance from ZTLM – SERVIÇOS E COMÉRCIO, LDA. Once your order is accepted, you will be provided with a reference to track it.
If the service(s) are unavailable, ZTLM – SERVIÇOS E COMÉRCIO, LDA. commits to informing the user and refunding any amounts paid within 30 (thirty) days from the date of knowledge of such unavailability.

7. Payment methods
ZTLM – SERVIÇOS E COMÉRCIO, LDA. offers several payment options for your order online.
These may change without prior notice.

8. Contract termination
The Customer has, according to applicable law, the right to terminate the contract, which must be exercised in writing, by email, letter, within 14 days from the receipt of the order (Article 10, No. 1 of DL 24/2014 of February 14).
Articles (if applicable) must be returned within 14 days after communicating the decision to terminate the contract, accompanied by the original invoice (Article 13, No. 1 of DL 24/2014 of February 14).
Return shipping costs will be borne by the Customer, except when the items, due to their nature or size, cannot be returned by mail (Article 13, No. 2 of DL 24/2014 of February 14).
Returned items must meet the following conditions:
– Return of items and their accessories in good condition, with complete original packaging and accompanied by respective invoices;
– Original packaging sealed and with intact seals.
After contacting Customer Support and being given return instructions, the item may be returned following all instructions from ZTLM – SERVIÇOS E COMÉRCIO, LDA.
All items will be checked upon arrival at our service and will only be accepted for return if they meet the return conditions.
The refund will only be made after the technical verification of the product condition, within a maximum period of 14 days from the date of receipt of the free resolution communication.
ZTLM – SERVIÇOS E COMÉRCIO, LDA. reserves the right not to accept items that do not comply with these conditions.

9. Dispute Resolution
Under Regulation (EU) No. 524/2013 of the European Parliament and Council of May 21, 2013, you may use the ODR – RLL platform in Portuguese.

10. Final Provisions
ZTLM – SERVIÇOS E COMÉRCIO, LDA. may send the Customer information about products, promotions, or other items of interest to Customers.
Any content that is downloaded or otherwise obtained results from the user’s free decision and is carried out at their own risk, and any damage to the equipment used resulting from such operations will be the sole responsibility of the user.
The website and all its contents, including but not limited to, articles, opinions, texts, lists, manuals, photographs, drawings, images, video and/or audio clips, or marketing texts, as well as trademarks, logos, domain names, and any other elements that may be covered by property rights (including source codes) and/or other types of material are the property of ZTLM, Lda., and are protected against unauthorized use, copying, or disclosure, by national laws and international treaties relating to Intellectual Property Rights.
The user authorizes ZTLM, Lda to use their data to send information about new services and updates to TOConline. All information received by ZTLM, Lda through TOConline is considered confidential by the Privacy Policy without the need for express authorization from users and/or customers.
